Circuit Court Judge Theresa Adams today issued opinions in the litigation brought by the opponents to the sale of the Citizens Care & Rehabilitation Center and Montevue Assisted Living facility. In one opinion, she dismissed the lawsuit filed as an administrative challenge to the June 25, 2013, resolution of the Frederick Board of County Commissioners authorizing the sale of the facility.
In a separate opinion, Judge Adams granted the county’s Motion for Summary Judgment on two of the counts, but denied the motion as to the remaining four counts. This allows these four claims in the Declaratory Judgment lawsuit to proceed to trial.
